Leave And Overtime (OT) Policy
Details the protocol for leave requests and overtime compensation
Each employee at Gear Inc. is not just a hardworking worker, but also a person with a full range of emotions, responsibilities, and personal needs. For this reason, Gear Inc.’s leave policy is built on respect, flexibility, and empathy for each individual. Gear Inc. believes that only when the mind and spirit are rested can employees deliver the best performance for the company.
We will have paid days off.
These days are divided into 2 categories:
Paid by the Company
Paid by Social Insurance (applying for employees who are participating in social insurance at the company)
Important Note:
For any type of leave (except for national holidays and summer holiday), when requesting leave from the team leader, employees must select the number of leave days and clearly specify the type of leave (annual leave, personal leave).
For employees in the Somo and Express teams, due to the 24/7 nature of the business, they might not have national holidays off according to the official calendar, but will take turns having different days off. If an employee works on a national holiday, they will receive a different pay rate compared to regular working days.

Special leave hours for Female Employees
1. National Holidays
In a year, there are 11 national holidays:
– New Year’s Day (January 1st): 1 day
– Lunar New Year (according to the lunar calendar): 5 days
– Hung King’s Festival (Mar 10 in the Lunar calendar): 1 day
– Reunification Day ( April 30th): 1 day
– Labour Day (May 1): 1 day
– Independence Day (September 1st and 2nd): 2 days
Note: In case holidays are on Saturday and Sunday, the employees will be given compensatory leave on the next working day. Employees will be entitled to fully paid days off on the above holidays.
2. Annual Leave
– Full-time employees: 1 paid day off per month
– To express gratitude for employees’ loyalty to the company, those who have worked for 5 years or more will receive an additional 1 annual leave day. Those with 10 years or more will receive an additional 2 annual leave days and those with 15 years or more will receive an additional 3 annual leave days.
– Employees can accumulate annual leave days, up to a maximum of 20 days. If the number of days exceeds 20, the company will convert the excess into a bonus and pay it along with the salary at the end of that month.
Please inform your manager to record leave days and note annual leave.
3. Personal Events
– 3 paid days off for an employee’s wedding
– 1 paid day off for the wedding of an employee’s son or daughter
– 3 paid days off for bereavement related to the employee’s parents, parents-in-law, spouse, children, grandchildren, or siblings

4. Summer Holiday
The company offers 2 summer holidays on the 3rd and 4th of July each year for employees to have the opportunity to travel with family, friends, and colleagues.
In addition to these two summer days off, full-time employees will receive an additional summer bonus

5. Leave Policy for Female Employees
(Effective from October 1, 2023)
This policy applies to all female full-time employees at Gear Inc. Vietnam, including employees who are in their probationary period.
– Menstrual leave policy for female employees during menstruation days: Eligible employees will receive an additional 1.5 hours of paid leave per month, which will be accumulated in their total paid leave hours (including annual leave and other paid leave categories).
– Childcare leave policy for female employees raising children under 12 months old: Eligible employees will receive 1 hour of paid leave for each actual working day, which will be accumulated in their total paid leave hours (including annual leave and other paid leave categories) within the year.

For Part-Time Staff
– The company pays 70% of the average salary from the previous 6 months for female staff who take full maternity leave and for male staff who take full paternity leave according to the Government’s regulation.
– The paternity leave period must be within the first 30 days from the date of childbirth. Male staff need to inform their direct manager 2 months in advance about their leave.
– These days off are considered unpaid leaves, please see the above table for more detail.
2. Sick Leave
The required documents are as follows:
– For employee illness: Original certificate of health facility for your off days to claim Social Insurance or a notarized hospital discharge paper.
– For an employee’s sick child (applicable for children under 7 years old): Hospital discharge paper and a notarized birth certificate of the child.
Note:
– The number of days off depends on the medical condition of the employee or the employee’s child, as specified on the medical facility’s confirmation.
– The hospital discharge certificate has the same date of issue as the last day of treatment.
– The certificate of health facility for your off days to claim Social Insurance has the same date of issue as the first day of treatment.
